New Delhi 고등법원(High Court)은 8월 중순 “3人 행정관위원회”(a three-member Committee of Administrators /CoA)를 지명하여 인도올림픽협회(IOA: Indian Olympic Association)을 인수하도록 (to take over the Indian Olympic Association)판결하였습니다.

3인 멤버로는 인도 (1)前職 대법원판사(former Supreme Court judge)인 Anil R Dave와 (2)前職 선거관리위원장(former chief Election Commissioner)인 Dr. SY Quraishi 및 前職 인도 외교부장관(former secretary of Ministry of External Affairs)인 Vikas Swarup로 구성한다고 합니다.
또한 (1)Abhinav Bindra(Beijing2008올림픽 금메달리스트), (2)Anju Bobby George, 및 (3)Bombayla Devi Laishramare 3인은 이들 3인 CoA를 컨설턴트 자격으로 보좌하는 것으로 지명(named consultants who will be assisting the CoA)되었다고 합니다.
고등법원의 판결(ruling)에 따르면, 상기 3인 행정관위원회(CoA)는 “인도올림픽협회를 일상적으로 관리 통치 책임”(in charge of carrying out "day-to-day governance of IOA)을 위임 받으며 “IOA정관준비와 채택을 위해 지원하고”(assist in preparation and adoption of the Constitution of IOA) “정관 규정에 의거한 집행위원회선거를 실시할 목적으로 선거인단명부/선거인단구성을 제안된 바대로 준비함”(prepare the Electoral Roll/Electoral College for the purpose of conducting the elections to the Executive Committee in accordance with the provisions of the Constitution, as may be proposed)이라고 되어 있습니다.
Manmohan and Najmi Waziri 등 2명의 판사들(justices)은 국가스포츠법령(National Sports Code)준수에 대한 “IOA의 끈질긴 완고한 저항으로 인해 그러한 판결이 나왔다(IOA’s "persistent recalcitrance" to comply with the National Sports Code led to the decision)고 주장하였습니다.
법원의 주문 결정은 선임 변호사(senior advocate)인 Rahul Mehra의 소송 청원에 근거하여 내려진 것이라고 합니다
Mehra변호사는 “본인의 첫 소송은 22년 전에 제기하였으며 많은 세월이 경과한 후지만 결정이 내려져 기쁘며”(I filed my first litigation 22 years ago and it feels great that after so many years, a decision has come) “이러한 판결은 투표권이 없어 침묵하는 인도의 수많은 스포츠인들에 거둔 승리임”(This is a win for the many voiceless sportspersons of India)이라고 승소한 소감을 피력하였습니다.
법정판결주문에 따르면 “CoA는 스포츠법령과 상기와 같이 판시한 바 대로의 정관규정관점에서 새롭게 선거가 실시 때까지 IOA의 지배구조관리를 위한 모든 적절한 조치들을 자유롭게 취하도록 할 것임”(CoA would be at liberty to make all appropriate arrangements for the governance of IOA until fresh elections are held in terms of a Constitution conforming to the Sports Code and as noted hereinabove)이라고 판시하였다고 합니다.
CoA는 “선거를 원활하게 실시하고 되도록이면 CoA구성원들이 동의한 날로부터 16주 기간 내에 채택될 정관의 관점에서 민주적으로 선출된 기구에 업무재량권을 인계할 것”(to "facilitate the holding of elections and the handing over of the affairs to a democratically elected body in terms of its Constitution which will be adopted, preferably within a period of 16 weeks from the date the CoA members give their assent)을 명령 받았다고 합니다.
2021년 12월에 실시하기로 했던 IOA임원선거는 이번 소송으로 인해 집행중지상태(kept in abeyance)였습니다
한편 IOC는 IOA로 하여금 수주 내에 관련 임원산출선거를 실시하라고 요구하면서 이행하지 않으면 자격정지처분에 직면할 것(asking the NOC to hold its elections in the coming weeks or risk facing suspension)이라는 한달 전인 7월20일부로 서한을 발송한 바 있습니다.
하지만, IOC가 과연 또 다른 16주라는 기간을 기꺼이 기다려 줄 지 여부는 두고 볼 일입니다.
IOC는 “IOA에게 발송한 7월20일 자 IOC서한에 추가할 내용이 없다”(have nothing to add to the letter sent to the IOA on 20 July)고 확인한 것으로 알려졌습니다.
IOC는 2012년 당시 IOA임원선거과정에서 IOC 올림픽 헌장규칙준수를 하지 않은 IOA에 대한 자격정지 등 금지 처분을 내린 바(previously banned the IOA for failing to comply with its rules in the election process in 2012) 있었습니다.
인도고등법원은 또한 집행부임원들의 임기와 투표권에 대한 우려로(after concerns over the tenure of office bearers and voting rights)”종신 회장”(Life President)이란 제도를 폐지하였으며 집행위원회 임원들의 최대 임기가 인도 법에 따라 3회까지로 제한되어야 한다(the maximum term for Executive Committee members must be limited to three tenures as per the law of the land)고 판시하였습니다
다른 판시 내용 중에 법정은 IOA집행위원회에 여성행정관리자들의 참여 필요성을 강조(underlined the need for women administrators in IOA’s Executive Committee)하기도 하였습니다.
법정 판시 내용 중 스포츠 계에서 여성의 두드러진 참여가 인정되어야 할 충분한 이유(every reason to acknowledge women’s significant presence in the sporting world)가 있으며 스포츠행정관리직은 남성전용 몫(a male preserve)이 아니라고 하였으며 IOA존속 95년이란 세월 동안 회장이나 사무총장 중 여성이 자리를 차지한 적이 없었음이 기록으로 나타나 있음과 여성도 결정권이 부여된 자리에 진출하기를 확실히 열망하고(Surely women do aspire to be in significant positions in the decision-making process) 있음과 IOA 일반직(GB: General Body)이나 집행위원회(EC: Executive Committee)직에 여성 몫이 보장되어야 함과 따라서 GB와 EC에 공히 투표권을 가진 스포츠인들의 카테고리의 절반을 여성으로 구성되어야 함(women shall comprise half of the category of sportspersons with voting rights in the General Body as well as in the EC)을 공시하였습니다.
법정 주문 결정내용에는 “명시된 상기 시한 내에 IOA가 법령을 준수하지 않을 경우, 인도정부가 NOC인증을 정지할 수 있음”(the Government will "suspend" the National Olympic Committee’s recognition if the "compliance is not done by IOA, within the time specified hereinabove)을 판시하였습니다.
또한 “CoA와의 협력의 긴급성과 스포츠관계법령준수의무는 IOA에 있음”(The urgency for cooperation with the CoA and onus for compliance with the Sports Code is upon the IOA)이란 내용도 포함되어 있다고 합니다.
인도는 2023년 Mumbai에서 차기 IOC총회를 개최하기로 되어 있으며 2036년 올림픽 및 패럴림픽개최에 관심이 있음을 표명한 바 있습니다.
