[Bach IOC위원장 직 사퇴 촉구 받고 있는 내막은?]

 

1)   2017년12월30일 한 외신기사제목은 “Rodchenkov변호사에 의해 강대국 러시아에 아첨하고 있다고 비난 받은 후 Bach IOC위원장 직 사퇴 촉구 받다”(Bach urged to resign as IOC President after being accused of "kowtowing to powerful Russia" by Rodchenkov lawyer)였습니다

2)  Thomas Bach IOC위원장은 러시아정부의 조직적 도핑조작사건을 밀고한 내부고발자(whistleblower)인 Grigory Rodchenkov의 변호사 Jim Walden에 의해 IOC위원장 직에서 물러나라고 촉구 받아 오고 있는 것으로 알려졌습니다

 

3)  Jim Walden 변호사는 Bach IOC위원장의 리더십을 “애처롭고 한심하다”라고 묘사하면서(who described his leadership as “pathetic”) “강대국 러시아에 아첨하고 있다”(kowtowing to powerful Russia)고 비난하였다고 합니다

 

4)  Jim Walden변호사는 IOC가 모스크바 소재 국립 반 도핑 실험실 전임 소장(the former director of Russia's national anti-doping laboratory in Moscow)이었던 Rodchenkov를 보호할 수 없다는 IOC의 주장에 대하여 격하게 반응하였다(reacted angrily to claims that they are unable to protect Rodchenkov)고 합니다

 

5)  Rodchenkov는 2015년 11월경 미국으로 망명을 구하기 위해 러시아를 도망치기 전(before he fled the country to seek asylum in the United States)IOC에 보호조치를 요청하였던 것으로 추정됩니다

 

6)  그 이래로 Rodchnekov는 WADA와 IOC에게 소치2014동계올림픽을 포함하여 반 도핑행위관련 “체계적인 조작”(systematic manipulation of anti-doping practices)에 대한 증거의 많은 부분(much of the evidence)을 제공해 왔다고 합니다.

 

7)  그 결과 러시아는 평창2018에 울며 겨자 먹기 식으로 중립 깃발 아래 출전하게 된(Russia being forced to compete under a neutral flag at next year's Winter Olympic Games in Pyeongchang) 배경이기도 합니다

 

8)  Walden변호사는 IOC가 살해위협(death threats)을 포함하여 러시아 관료들 로부터 끊임없이 공격대상희생자(the victim of attacks from Russian officials)로 고통받아온 Rodchenkov를 보호하기 위해 더 많은 조처를 취했어야 했다(should have done more to protect Rodchenkov)고 주장하고 있다고 합니다

 

9)  Walden은 뉴욕에 근거지를 둔 변호사로서 IOC가 러시아와 쿠웨이트를 다루는 방식이 대조적이라고(contrasted the treatment of Russia by the IOC with that of Kuwait) 주장해 오고 있다고 합니다

 

10) 쿠웨이트는 자국정부간섭으로 인해 IOC로부터 자격정지처분을 받는 바람에 Rio2016올림픽에 마지못해 “독자적 올림픽선수”(Independent Olympic Athletes)자격으로 출전한 바 있습니다.

 

 

11) 하지만 러시아 출신 선수들은 평창2018에 “러시아 출신 올림픽선수들”(OAR: Olympic Athletes from Russia)이란 깃발 하에 출전할 것(compete under the banner of OAR)으로 결정된 바 있으며 러시아올림픽위원회는 평창2018폐회식에서 러시아 깃발아래 참가할 수도 있는 자격복권이 가능할 것이라고 언질을 받아오고 있다(the Russian Olympic Committee have been told they could be reinstated in time to take part under their own flag at the Closing Ceremony)는 것입니다

 

12) 다음은 Walden Macht & Haran LLP 법률법인(law firm)의 창립멤버인 Walden변호사가 12월30일 밤 성명서를 통하여 발표한 발언 내용입니다:

 

A.  "Lest there be any doubt about the political nature of the IOC’s decision making, I recall it imposed a multi-year and continuing complete ban of Kuwait for acts far less serious than Russia’s criminality." (IOC의 결정절차의 정치적 성격에 대하여 의심의 여지가 없도록 하자는 취지에서 본인은 IOC가 러시아의 범죄행위보다 훨씬 덜 심각한 쿠웨이트 케이스에 대하여 수년 간 그리고 지속되는 쿠웨이트에 대한 전면금지행위를 부과한 것을 상기하고자 함)

 

B.  "The IOC cannot possibly justify this as anything other than kowtowing to powerful Russia, while using the so-called ‘nuclear option’ on a weaker country. (IOC는 이러한 작태가 소위 약소국에 대해 핵 선택권을 사용하고 있는 강대국 러시아에 대한 아첨행위가 아닌 그 어떤 다른 것이라고 정당화 할 수 없을 것임)  

 

C.  "From this perspective, the IOC has proven pathetic and a change in leadership is in order. (이러한 관점에서, IOC가 애처롭고 한심한 것임을 입증해 온 것이며, 리더십경질은 적절한 것임)

 

D.  "What Thomas Bach fails to understand is this is not about Dr. Rodchenkov, or [Vladimir] Putin, or even about Russian athletes. (Thomas Bach IOC위원장이 이해 못하고 있는 점은 이러한 사태가 Rodchenkov박사나 푸틴대통령이나 심지어 러시아 선수들에 관한 것이 아니라는 것임)

 

E.  "It is about the Olympic ideal. (그것은 바로 올림픽이상과 관련된 것이라는 점임)

 

F.   "And once that ideal is abandoned or corrupted, it is dead, and the Olympics become a series of cheap carnival games." (그리고 올림픽이상이 내 버려 던져지거나 타락된다면 그것은 죽은 것이며, 올림픽은 싸구려 카니발 축제대회로 전락하는 것임)

 

 

13)  Walden변호사는 동계올림픽과 월드컵대회가 다가옴에 따라 IOC와 FIFA내부에서는 Rodchenkov박사에 대하여 신뢰하지 않거나 침묵시키려는 시도의 일환으로 강력한 목소리가 이제 결성되어 가고 있다("powerful voices" within the IOC and FIFA "are now aligning to try to discredit or silence Dr. Rodchenkov as the Winter Olympics and the World Cup draw near")고 주장한 것으로 알려지고 있습니다.

 

14)  Walden변호사는 “그들의 정비된 능수능란한 술책을 조심해야 합니다”(Please watch for their coordinated sleight of hand) “그것이 다가오고 있습니다”(It is coming.)라고 첨언하였다고 합니다

15) 2017년 12월 말 Walden변호사는 자신의 성명서에서 IOC는 Rodchenkov박사가 자신의 안위를 걱정하기 때문에 스포츠중재재판소<CAS>에 증거제공이 이루어지지 않게 되면 안심할 것(the IOC would be happy if Rodchenkov were not available to give evidence at the Court of Arbitration of Sport because he feared for his safety)이라고 주장했던 것으로 알려졌습니다

 

16) IOC는 Walden의 주장에 대해 “우스꽝스러운 자기주장”(ridiculous assertion)이라고 주장함으로써(되 받아 쳤다(the IOC hit back by claiming)고 합니다

 

17) 하지만 Walden변호사는 다시 다음과 같은 논리에 입각하여 자신만의 반격으로(with his own counter-attack) 받아 치고 있다고 합니다

 

A.  "The IOC claims it has no power to protect Dr. Rodchenkov." (IOC는 Rodchenkov박사를 보호할 힘이 없다고 주장하고 있음)

 

B.  "This is obviously false. (이러한 주장은 명백한 오류임) 

 

C.  "In imposing the ban, the IOC said Russia would not participate in the Closing Ceremonies unless Russia 'fully respected and implemented' the IOC’s directive for compliance with its conditions. (금지령을 발동하면서, IOC는 러시아가 IOC가 설정한 지시사항을 전폭적으로 존중하지 않거나 실행하지 않을 경우 러시아가 폐회식에 참가할 수 없을 것이라고 언급하였음)

 

D.  "Yet, Russia denies the IOC’s conclusions, its officials are appealing their bans, and Russia continues to retaliate against the IOC’s main witness, Dr. Rodchenkov. (그런 와중에 러시아는 IOC의 결론지침을 부인하고 있으며 러시아 관계자들은 금지조치에 대해 항소하고 있는 중이고 또한 러시아는 IOC의 주요 증인인 Rodchenkoc박사에 대한 보복을 계속하고 있는 상태임)

 

E.  "The IOC can and should continue Russia’s complete suspension under these circumstances. (IOC는 이러한 상황 하에서 러시아에 대한 전면 자격 정지조치를 단행할 수 있으며 지속적인 자격정지를 계속해야 하는 것임)

 

F.   "Refusal to use this authority will lead to everyone to question the IOC’s motives, and to be skeptical of its resolve to protect clean Olympian athletes and whistleblowers." (이러한 권한사용을 거절한다는 것은 모든 이로 하여금 IOC의 동기와 의도에 대하여 의문을 품게 할 것이며, IOC의 정직한 선수들과 내부고발자 보호를 결의한 해결책에 대하여서도 회의적인 시각을 갖게 할 것임)
