TSX REPORT: WADA did this much right: they got the Russians angry! Or is it for show?
2019년 12월9일(월) WADA가 내린 결정은 러시아 반 도핑기구(Russian Anti-Doping Agency)를 4년 간 비 준수국가(non-compliant)로 붙잡은 것인데 이에 대하여 환호를 보이는 그룹도 있지만 러시아를 Tokyo2020올림픽 및 패럴림픽 대회 및 이후 대회에 완전한 금지조치를 원하고 있는 다른 그룹에서는 이러한 결정이 너무 관대하다고 간주하고 있다.(Monday’s decision by the World Anti-Doping Agency to hold the Russian Anti-Doping Agency to be non-compliant for a period of four years was cheered by some, but was considered too lenient by others who wanted Russia banned completely from the Olympic and Paralympic Games in Tokyo and beyond.)
대다수의 뉴스취재내용 중 빠진 것은 지난 2018년 4월 발표 및 시행된 소위 서명 국들에 의해 설정된 ‘관련 법규 준수 국제 표준’ 하에 러시아에게 내려진 제재조치에 참조된 규정이다. 그 안에는 11항 2.6 세칙이 상황을 통제하고 있는 바 아래 문구는 적절한 텍스트내용을 보여주고 있다(Lost in most of the coverage, of course, was any reference to the regulations under which the Russian sanctions were imposed, namely the International Standard for Code Compliance by Signatories, issued in April 2018.
In it, section 11.2.6 controls the situation; simplified below to show only the pertinent text):
“법규의 근간이 되는 목적을 달성하기 위하여 결론사항이 필요이상으로 확대되어서는 안 된다. 특히 결과조치로 말미암은 선수들 배제 항목에서 그 결론적 조치에 대하여 참작여부가 가능한지인데 서명 당사국들의 비 준수로 인해 어떠한 경우라도 선수들에게까지 그 영향이 미치지 않도록 해 주는 메커니즘 체계를 창출하고 실행하는 것이다(“The consequences should not go further than is necessary to achieve the objectives underlying the Code. In particular, where a consequence imposed is exclusion of Athletes ... consideration should be given to whether it is feasible ... to create and implement a mechanism that enables ... Athletes ... to demonstrate that they are not affected in any way by the Signatory's noncompliance.)
그렇다면 그리고 선수들로 하여금 중립적 자격(예를 들면, 해당국 대표가 아닌 자격) 스포츠대회 참가허용이 결과조치의 효과를 반감시키지 않고, 또는 해당국 선수들에게 정정정당 하지 않는 수준이 아니고, 또는 해당스포츠대회의 청렴도 또는 도핑의 해악에 비추어 스포츠의 순수성을 수호하는 WADA의 약속에 대한 대중적 신뢰를 손상시키지 않을 것이 명백할 경우, 그 때에는 WADA의 통제 하 및 또는 승인을 전제로 그러한 메커니즘이 허용될 수 있다” (“If so, and if it is clear that allowing them to compete in the Event(s) in a neutral capacity (i.e., not as representatives of any country) will not make the ... WADA집행위원회의 결정사항이 스포츠중재재판소에서 확정되기 위하여, WADA는 이러한 규칙들을 준수해야 한다. 이러한 제반 규칙들을 준수해야 하고 아니면 스포츠중재재판소에 의해 재제조치가 파기 환송되어야 한다(In order for the decision of the WADA Executive Committee to be upheld at the Court of Arbitration for Sport, it must follow these rules. MUST follow these rules, or have its sanctions reversed by the Court of Arbitration for Sport.)
WADA제재조치내용이 너무 가볍다는 다소 신경질적인 논평과 또 한편으로는 러시아가 심지어 이러한 수준의 제제조치로부터는 깨닫게 되지 않을 것이라는 견해도 견지하고 있으며 또 한 부류는 러시아소식통으로부터 나오는 논평은 처벌조치가 너무 혹독하다고도 한다.(There were some hysterical comments that the sanctions were too light, some very considered views that the Russians simply will not learn from even this level of sanction, and comments from Russian sources that the penalties were too severe.)
● 항상 신중한 올림픽 2관왕이면서 미국 반 도핑기구 명예회장인 Edwin Moses는 AP와의 화상인터뷰에서 자신은 처벌수위가 러시아사람들이 향후 행위에 변화를 초래하리라고는 느끼지 않는다고 언급했다(The always-thoughtful Edwin Moses, Emeritus Chair of the U.S. Anti-Doping Agency <and two-time Olympic gold medalist>, told the Associated Press on video that he doesn’t feel the penalties will result in a change in future actions by the Russians):
“나는 <러시아 인들의 행태가> 변화되리라는 것에 전혀 낙관적이지 않다. 그들은 이미 3차례 방망이를 휘둘러 삼진 아웃에 이르렀다. 그들이 적나라하게 보여온 표리부동, 기만과 허위는 이제 그 한계를 벗어났으며, 지금 전 세계 선수들 모두에게 당혹감을 안겨 주고 있고, 현 단계에서 그들은 언필칭 정직한 선수들이라고 지칭하는 선수들의 권리를 찾고자 투쟁하고 있는 상황이라고 생각한다. 그러는 동안 그들은 면제 부를 줄 수 있거나 유죄행위를 찾을 수 있는 근거가 되는 선수들 관련 모든 데이터를 훼손시켜오고 있다 (“I’m not optimistic at all that that’s going to change. They’ve had three swings at the bat. Struck out three times. The duplicity, deceit and deception that they exhibited is just beyond the pale, and I think it’s an embarrassment to the athletes in the world that now, at this stage, they’re fighting for the rights of their clean athletes, as they call them. Meanwhile, they’ve destroyed all the data that could either exonerate them or find that they’re guilty. So that within itself is another layer of deception.”)
WADA가 발행한 성명서는 “WADA가 지금 LIMS데이터베이스 안에 저장된 의심의혹이 있는 모든 선수들의 명단을 가지고 있으며 부단히 애쓴 범죄과학적 감식 조사덕분에, 이 자료는 해당 데이터가 조작되었거나 삭제된 선수들 명단도 포함하고 있음을 주목하고 있다면서 의견에 동조하지 않았으며” WADA의 RUSADA의 운영에 대한 최신 회계감사결과를 포함한 증거를 미루어 볼 때 RUSADA의 업무내용이 러시아 스포츠 내에 반 도핑 투쟁에 효과적으로 기여하고 있다라는 러시아 반 도핑기구<RUSADA>의 현 운영체계에 대한 논평을 지지하였다. (WADA’s statement disagreed, noting that “WADA now has the names of all suspicious athletes in the LIMS database, and thanks to the painstakingly forensic nature of the investigation, this includes the athletes whose data was manipulated or even deleted” and endorsed a comment on the current operations of the Russian Anti-Doping Agency that “the evidence (including from WADA's recent audits of RUSADA's operations) indicates that RUSADA’s work is effective in contributing to the fight against doping in Russian sport.”)
●IOC측은 제제조치가 확연히 실행되었었다는 견해를 강조한 성명서를 발표하였다(For its part, the International Olympic Committee issued a statement that underscored that its view of the sanctions had been implemented):
한편, 우리는 보고서 내용을 통하여 스포츠운동이 이렇게 조작행위에 연루된 적이 없어 왔으며, 보고서내용자체가 특히 러시아올림픽위원회와 위원들과 관련하여 스포츠운동에 의해 자행된 그릇된 행위를 적시하지 않고 있음을 주목하는 바이다. 이러한 문맥에서 IOC는 WADA가 반 도핑 비 준수 행위에 의해 어던 방식으로도 연루되지 않음을 보여줄 수 있는 범위에서 러시아선수들이 경기에 출전하도록 제시하고 있는 기회제공에 대하여 환영하는 바이다. (“At the same time, we also note that the report finds that the sports movement has not been involved in any of this manipulation, and that the report does not indicate any wrongdoing by the sports movement in this regard, in particular the Russian Olympic Committee or its members. In this context, the IOC welcomes the opportunity offered by WADA to Russian athletes to compete, ‘where they are able to demonstrate that they are not implicated in any way by the non-compliance’.”)
● 러시아로부터 나온 반응은 예상대로 격렬하였다. 러시아 관영뉴스통신사인 TASS는 “러시아 스포츠에 불어 닥친 도핑 스캔들이란 주제 하에 12월 한 주 중 3일에 걸쳐 다음과 같은 제하에서 27편의 기사를 게재하였다 (The response from Russia was predictably furious. The Russian TASS news agency posted 27 stories on the topic of “Doping Scandal in Russian Sports” from Monday through Wednesday, including these headlines):

= “Russian athletes’ status in 2020 Olympics depends on length of CAS review”

12월 해당 주 수요일에는 국제복싱연맹(AIBA)이 누적하고 있는 부채 US$1,600만 불 지급을 시사한 바 있었던 러시아복싱연맹사무총장인 Umar Kremlev는AP통신과의 인터뷰에서 러시아 복싱선수들이 중립적인 선수자격출전을 요구하는 제재조치가 번복 및 파기될 경우에만 Tokyo2020올림픽에 참가할 것(Russian boxers will participate in the 2020 Olympic Games only if the sanctions requiring them to compete as neutrals are reversed.)이라고 발언하였다.
문제는 WADA의 결정이 반 도핑 비 준수의 경우 약점을 지니고 있는데 WADA의 제재조치가 단지 올림픽, 패럴림픽, 시니어 수준의 각종 세계선수권대회에 한하여 적용됨으로 해서 연령 별 그룹(age-group),주니어 또는 마스터즈 급( cadet or junior /or Masters events)대회에는 적용되지 않는다는 것이다.
게다가 제제조치에 규정되어 정의 된 대회에 러시아의 Saint Petersburg로 하여금 B그룹대회 와 8강전 시합을 개최할 예정인 유럽축구연맹 유로2000축구대회(UEFA Euro2020)와 같은 대륙 선수권대회(Continental Championships) 또는 지역선수권대회(Regional Championships)는 포함기준에 누락되어 있어서 러시아 팀이 그 곳 경기에 출전하는데 아무런 문제가 없다라는 것이다.
