[올림픽 헌장(Olympic Charter), 인권(Human Rights)관련 강력한 메시지(Strong Message) 개정 제안한 IOC집행위원회(9월8일)]
IOC 집행위원회(9월8일)는 Bach IOC위원장이 초점을 두고 있는 “가치”(values)에 대한 일치된 움직임을 지속적으로 추구하는 올림픽운동의 일환으로 인권 요구사항(human rights requirements)과 관련하여 올림픽 헌장에 새로운 제반 규정을 제안하였다고 합니다.
Bach IOC위원장의 유산을 공고히 하려는 움직임으로 IOC집행위원회는 인권 요구사항을 결합하기 위하여 올림픽 헌장 개정안을 제출하였다고 합니다.
Bach IOC위원장은 자신의 임기 동안 UN에 대하여 소신 있는 지지자(unabashed supporter)로 일관하고 있으며, 러시아와 벨라루스 선수들에 대한 Paris2024올림픽 포용에 대한 열렬한 태도를 포함한 다수의 이슈에 대하여 IOC의 입장의 근거로써 IOC의 “가치”(values)를 빈틈 없이 옹호해 온 것으로 알려져 있습니다.
다음달 10월 Mumbai개최 IOC총회의 인준을 남겨 놓고 있는 다음의 3가지 추가 장착 구절(three insertions)에 대하여 IOC집행위원회가 승인하였다고 합니다:
●올림픽 헌장 첫 구절에 명시된 올림피즘의 근본 원칙 항목 1항에서(In Fundamental Principle of Olympism 1), “올림피즘은 노력하는 즐거움과 선한 사례가 되는 교육적 가치와 국제적으로 인정된 인권에 대한 사회적 책임과 존중과 올림픽운동의 검토과제범주 내에서 보편 타당한 윤리적 원칙을 바탕으로 한 생활 방식을 창출하도록 추구함”(Olympism seeks to create a way of life based on the joy of effort, the educational value of good example, social responsibility and respect for internationally recognised human rights and universal fundamental ethical principles within the remit of the Olympic Movement.)
● 올림픽 헌장 올림피즘의 근본원칙 항목 4항에서 “모든 개개인은 올림픽 운동의 검토과제범주 내에서 국제적으로 인정된 인권과 관련하여 어떤 종류의 차별도 없이 스포츠를 실행하도록 접근이 허용되어야 함”(Every individual must have access to the practice of sport, without discrimination of any kind in respect of internationally recognised human rights within the remit of the Olympic Movement.)
● 올림픽헌장규칙 제40조에 추가하여(Added to Rule 40) “올림픽에 참가하는 모든 선수들과 임원들 또는 기타 관련 임원들은 올림픽 가치와 올림피즘의 근본 원칙과 일치하며 IOC집행위원회가 정한 가이드라인에 준하여 표현의 자유를 누려야 함”(All competitors, team officials or other team personnel in the Olympic Games shall enjoy freedom of expression in keeping with the Olympic values and the Fundamental Principles of Olympism, and in accordance with the Guidelines determined by the IOC Executive Board.)
상기 3가지 개정안(amendments)은 매우 조심스럽게 다듬어졌는데 예를 들면 첫 번째 항목의 제한사항으로 “올림픽운동검토과제 범주 내에서”(within the remit of the Olympic Movement)와 국제정치라는 광범위한 틀 내 에서가 아니라 올림픽 스포츠 내에서 IOC의 책임에 일치하여(keeping the IOC’s responsibilities within Olympic sport and not within the wider frame of international politics) 라는 구절이 그렇게 보이는 것으로 평가된다고 합니다.
또한 올림픽 헌장 규칙 제40조에 추가되는 “표현의 자유”(free expression)관련 내용은 “정치적, 종교적 또는 인종적 선전은 그 어떤 종류라 할지라도 표출되는 범위에 있어서 그 어떤 것이라도 올림픽 관련 지역과 경기장 및 다른 관련 범주에서 허용되지 않음”(No kind of demonstration or political, religious or racial propaganda is permitted in any Olympic sites, venues or other areas)이라는 구절이 폭넓게 논의 된 규칙 제50조 2항에 대한 그 어떠한 변경 사항에도 동반되지 않고 있는 것(not accompanied by any change to the widely-discussed Rule 50.2)이라고 합니다
올림픽헌장개정의 목적은 인권 및 올림픽에서 표현의 자유에 대한 존중을 확고하 하기 위한 것(to ensure respect for human rights and freedom of expression at the Olympic Games)으로 알려지고 있습니다
올림픽헌장개정구절에 IOC가 추가하기를 원하고 특히 눈에 띄는 표현은 “국제적으로 인정된 인권”(internationally recognised human rights )과 “올림픽운동검토과제 범주 내에서”(within the remit of the Olympic Movement)라고 생각됩니다.
10월 Mumbai개최 IOC총회에서 올림픽헌장개정 제안 내용이 승인될 경우 올림피즘의 근본 원칙 1항 구절은 “Olympism is a philosophy of life, exalting and combining in a balanced whole the qualities of body, will and mind.”이어서 “Blending sport with culture and education, Olympism seeks to create a way of life based on the joy of effort, the educational value of good example, social responsibility and respect for internationally recognised human rights and universal fundamental ethical principles within the remit of the Olympic Movement.”라고 개정될 것으로 보입니다.
올림피즘 근본 원칙 4항 구절이 교체되도록 제안되는 부분은 “the possibility of practising sport”라는 기존 구절은 “access the practice of sport”로 변경되며 “in respect of internationally recognised human rights within the remit of the Olympic Movement”라는 구절이 추가되어 교체됩니다.
따라서 제안되고 있는 해당 조항 구절은 “The practice of sport is a human right.”은 그대로 남게 되며 다음 구절이 수정되어 “Every individual must have access to the practice of sport, without discrimination of any kind in respect of internationally recognised human rights within the remit of the Olympic Movement” 그리고 이어서 “The Olympic spirit requires mutual understanding with a spirit of friendship, solidarity and fair play”로 현행 구절과 대동소이(大同小異)합니다.
Bach IOC위원장은 계획하고 있는 개정 구절(planned alterations)은 “IOC의 인권관련 업무에 있어서 중요한 이정표로 기록될 것”(important milestone in the IOC’s human rights work)이며 “이것은 올림픽 운동에서 인권 존중에 대한 우리가 내놓은 약속 이행의 주요한 발자취임” (This is a major step in our commitment to the respect for human rights in the Olympic Movement) “올림픽 헌장에 이러한 개정을 통하여 우리는 우리 이해관계자들에게 강력한 메시지를 보내고 있는 것임”(With this change to the Olympic Charter, we are also sending a strong message to our stakeholders)이라고 언급하였다고 합니다.
IOC의 기존 올림픽 헌장 규정에 명시된 정책으로 인해 Tokyo2020올림픽의 여정에서 “흑인의 삶/생명도 중요함”(Black Lives Matter)운동에 대하여 다수 종목의 선수들이 지지를 표명한 것과 같이 엄청난 비판에 직면한 바(faced heavy criticism in the build-up to Tokyo 2020 as athletes in a multitude of sports showed support for the Black Lives Matter movement) 있었다고 합니다.
IOC는 올림픽에서 데모와 항의집회에 대한 규칙을 부분적으로 완화하는 것에 동의하였지만(agreed to partially relax rules on demonstrations and protests at the Olympics) 메달시상대에서의 그러한 행위는 금지되어야 할 것이라고 주장하였다(insisted such acts on the podium remained banned)고 합니다.
IOC집행위원회가 제안한 올림픽 헌장 개정 구절은 10월15일~17일 Mumbai개최 IOC총회에서 무난히 승인될 것으로 예상되고 있다고 합니다.
