[국제복싱연맹(AIBA) 증발된 수백 만불 혐의 연루된 한국인 전임임원 형사상 추적 중]

 

11월11일 자 한 외신기사 제목은 “국제복싱연맹 사라진 수백 만불 행방관련 전임 전무이사에게 형사상의 죄목 추구키로 약속하다”(AIBA promise to pursue criminal charges against former executive director over missing millions)였습니다.

국제복싱연맹(AIBA: The International Boxing Association)이 AIBA계좌에서 사라진 것으로 의심되는 기금을 둘러싸고 진행되고 있는 조사의 일부로 (part of investigation) 김호 전임 AIBA전무이사에 대해 형사상의 죄목(criminal charges)으로 추적할 예정이라고 합니다.

 

뉴욕 타임즈(New York Times)지에 따르면 세계적인 회계법인업체인 PwC(Pricewaterhouse Coopers)가 착수한 조사에 따르면 아제르바이잔 수도 Baku에 근거지를 둔 Benkons MMC 재벌(conglomerate)에 의해 할당된 US$1,000만 불 융자금의 거의 절반에 해당하는 금액(약 55억 원)에 대한 소명을 할 수 없다(could not account for)라는 회계감사결과가 나왔다라는 것입니다.

 

지난 2015년 6월 IOC의 지배구조 기준준수요청에 근거하여(following a request from the IOC to comply with good governance standards) CK Wu AIBA회장 겸 대만 IOC위원으로부터 위탁 및 의뢰 받아 실시되고 작성된 PwC의 회계감사보고서는 아직 발행되지 않았다고 합니다.

 

동 보고서는 1년 전에 작성 완료된 것으로 보도되고 있는 것으로 알려졌습니다.

 

AIBA는 해당융자금의 존재에 대해 인정하지만 김호와의 면담이 이루어지지 않아 PwC보고서를 배포하지 않게 되었노라고 주장하고 있다고 합니다.

 

그들은 AIBA전무이사 직위 해임되어 2015년 6월에 차석이었던 Karim Bouzidi가 그 자리를 승계한 바 있는 그 임원(김호)을 세계 복싱시리즈 미국 운영업체인 스위스소재 수혜대상회사(the Swiss-based beneficiary company, World Series of Boxing<WSB> American Operations Ltd.)를 좌지우지한(entirely managing)것에 대하여 비난하고 있다고 합니다

 

Wu AIBA회장과 집행부임원들은 돈이 증발되었었는지 여부에 대하여 전혀 인지하지 못하였다는 주장을 펴고 있다고 합니다.

 

김호 전임 AIBA전무이사는 미국에서 WSB(World Series of Boxing)발진을 위해 자금을 제공한 아제르바이잔 회사와의 융자금 협상에서 ‘폭 넓은 재량권’(wide discretion)을 향유하였다고 하는데 AIBA는 자금의 일정 부분이 증발하였다는 의혹이 제기된 후 이같이 주장한 것으로 알려졌습니다.

 

AIBA측 성명서 내용입니다:

 

(1) "AIBA wishes to reiterate, as it has done for many months and in several media outlets, that the lingering issue of an Azeri loan is under discussion in complete transparency with the creditors." (AIBA는 수 개월 동안 여러 매체를 통하여 밝혔듯이 아제르바이잔 융자금관련 떠돌고 있는 이슈가 채권자들과 명명백백한 투명한 가운데 논의되고 있음을 반복해서 강조하고 하고자 함)

 

(2)  "AIBA does not deny that a loan was granted by an Azeri company in order to help fund the launch of the World Series of Boxing in America. (AIBA는 미국에서 WSB착수를 위하여 자금지원을 한 아제르바이잔 기업으로부터 융자대출금이 승인되었음을 부인하지 않고 있음)

 

(3) "Said loan was, however, granted to a company registered in Switzerland, WSB America Operations Ltd, which was entirely managed by Mr Ho Kim as WSB AO Ltd sole Board member with the support of his niece officiating as coordination director." (동 융자대출금은 스위스에 등록된 회사이며 김호가 유일한 단독 집행위원으로 좌지우지 해온 WSB America Operations Ltd.에 김호의 질녀가 조정관으로 직무를 수행하며 지원하는 가운데 WSB AO Ltd에 승인되어 교부 된 바 있음)

 

 

김호는 2015년 AIBA전무이사에서 해임당하였으며 차석이었던 Karim Bouzidi가 후임으로 선임 교체된 바 있다고 합니다. (Kim was fired from his position and replaced by deputy Karim Bouzidi in June 2015.)

 

하지만 Bouzidi 역시 그 이후 AIBA를 그만 두었다고 전해 지고 있습니다.

(4) "Initial PWC report did not interview one key representative of the governance at the time, Mr. Ho Kim".(초기 PwC회계감사보고서는 당시 지배구조 상의 핵심대표였던 김호와의 면담을 누락하였음)

 

(5)  "Consequently, many of the findings in the PWC report require further investigation. (결과적으로 PwC보고서안에 명시된 소견내용의 많은 부분들은 좀 더 치밀한 조사가 필요한 대목이 결여되어 있음)

 

(6) "This is why AIBA, which has taken the initial step of commissioning the report and is addressing its contents in the appropriate manner, has requested an additional report to confirm the financial discrepancies in the initial findings. (그렇기 때문에 보고서 작성을 위임하는 첫 조치를 취하였으며 적절하게 내용을 명시하고 있는 AIBA가 초기 소견서에서 재정적 재량권을 확인할 추가 보고서를 요청한 이유임)

 

(7) "AIBA's former executive director Ho Kim found the Azeri investor and enjoyed wide discretion in the negotiations and implementation of the transaction. (AIBA 전임전무이사 김호는 아제르바이잔 투자가를 찾아내었으며 거래 협상 및 실행과정에서 폭 넓은 재량권을 향유한 바 있음)

 

(8) "Mr. Kim acted autonomously in the establishment of WSB America Operations Ltd and was the sole Board member of said company, which completely managed the World Series of Boxing in the United States and Mexico." (김호는 WSB America Operations Ltd를 설립하는 데 자체적으로 행동하였으며 동 회사 유일한 집행위원이었기에 미국과 멕시코에서 WSB 복싱시합 관리를 전적으로 좌지우지 하였음)

 

(9) "Actions will be taken in due time should any of the allegations made in the article regarding the loan of $10 million - and its use by WSB America Operations Ltd - are eventually proved to be correct". (US$ 1,000만 불 대출금관련 조항에서 제기되었던 의혹들 중 어떤 내용이라도 궁극적으로 사실로 판명될 경우 시간 내에 필요 조치를 강구할 것임)

 

AIBA는 아제르바이잔으로부터 지급된 자금이 자국복싱 선수들에 대한 편파적인 판결을 유도하기 위하여 제공된 뇌물이 아니냐는 암시를 강하게 일축하였다고 합니다

 

(10)           "The most unacceptable suggestions in the article are a hypothetical link between the loan and Azeri performances in the ring." (조항 중 가장 용납할 수 없는 시사내용들은 대출금과 아제르바이잔 선수들의 링에서의 복싱시합과 가설적 연계 운운임)

계속되는 AIBA측의 동 건 관련 성명서내용입니다:

 

(1) "President Wu is determined to obtain justice for AIBA and to take all necessary measures for that purpose." (Wu회장은 AIBA를 위한 정의구현을 이루기 위한 결단을 내려 모든 필요한 조치를 강구하기로 결정한 상태임)

 

(2) "As a victim of a financial and reputation damage, AIBA will press charges against Mr. Ho Kim with an aim to launch a criminal investigation, which will cast full light on the facts, which will determine if criminal activities were perpetrated to the detriment of AIBA in connection with the Azeri loan, and, eventually, which will serve to recover the damages suffered. (재정적, 평판적 피해 당사자로써의 AIBA는 관련 사실들에 대해 모든 진상을 명명백백히 밝히게 될 형사상의 수사에 착수할 목적으로 김호에 대한 모든 혐의를 입증하고자 전력을 다할 것이며 이를 통하여 아제르바이잔 융자금과 연관된 해당범죄행위의 AIBA 이미지손상여부를 결정이 판가름 나면 결국 그 동안 당한 피해를 회복시켜줄 것임)

 

(3) "We remind that Mr. Kim signed alone the first Memorandum of Understanding that eventually led to the loan. (우리는 융자금이 최종적으로 성사되도록 역할을 한 MoU에 단독으로 서명한 당사자가 바로 김호임을 상기 시키는 바임)

 

(4) "This loan was arranged for a separate legal entity from AIBA, WSB America Operations SA, which was operated solely by Mr. Kim as unique Board member of said legal entity. (동 융자금은 AIBA와는 별도의 법적 실체를 통하여 마련되었는데 그 법적 실체는 김호가 독단으로 운영해 온 WSB미국운영대행사였으며 김호 자신이 유일한 집행위원으로 활동하여 왔음)

 

(5) "It will be for the Justice to determine any potential criminal or civil liability." (이러한 조치는 정의구현을 통하여 그 어떠한 잠재적 범죄적 또는 민사적 채무에 대하여서도 해결의 실마리를 결정해 줄 것임)

 

김호는 자신이 Wu회장의 명령을 따랐을 뿐이라고 주장하였다고 합니다(Kim, however, claimed he was following Wu's orders.)

 

다음은 김호의 New York Times지와의 인터뷰 발언내용입니다:

 

(1) "He is not the person to sign any contract without understanding the terms and conditions." (Wu회장은 계약조건의 세부내용을 이해하지 않은 상태에서 계약서에 서명하는 사람이 아님)

 

(2) "When the investment funds were sent to the USA he approved all transfers. (투자자금이 미국으로 보내졌을 때 그는 모든 이전된 송금내역을 승인하였음)

 

(3) "He does not trust no one in regard to the finance matters." (그는 재정적인 사안에 관하여 아무도 신뢰하지 않는 사람임)

 

AIBA 측은 또한 2010년 김호가 필경 Kamaladdin Heydarov아제르바이잔 복싱연맹회장에게 써서 보냈던 것으로 추측되는 서한에서  “Wu회장의 서명이 오용/남용된 것처럼 보이는 흔적에 대해”(what appears to be a misuse of President’s signature) 조사 중이라고 주장하고 있는 것으로 알려지고 있습니다.

 

2016년은 AIBA로서는 어려운 해였는데 Rio2016올림픽 때 임명되어 활동하였던 36명 전원의 심판 진 전체가 자격정지 조치대상 명단에 포함시키기(included the suspension of all 36 referees and judges )까지 하였다고 합니다

 

아일랜드 밴텀급 세계챔피언인Michael Conlan 은 준준결승 예선전(a quarter-final bout)에서 러시아선수인 Vladimir Nikitin을 제압하였었는데도 패배 판정을 받은 후 그는 아마추어 복싱이 “뿌리에서 머리끝까지 통째로 다 썩어 악취가 진동한다”(stinks from the core to the very top)고 주장한 바 있다고 합니다

AIBA 측은 또한 아제르바이잔 측에서 자국복싱선수들과 연계된 시합판정들에 영향력을 발휘하도록 하기 위한 일환으로 보낸 지불 금 존재에 대한 암시징후들에 대하여 반박한 것으로 알려졌습니다

 

아제르바이잔 선수들은 2010년 이래 AIBA 세계복싱선수권대회에서 금메달 4개를 포함하여 9개 메달을 획득한 바 있다고 합니다.

 

AIBA측의 언급내용입니다:

 

(1) "AIBA will not tolerate any interference with the field of play and in the face of the ongoing attacks from vested interests both with and without direct links to the organization." (AIBA는 해당조직과의 연관여부와 관계 없이 그리고 기득권으로부터 취해지는 현재 진행중인 공격에 직면하여서도 경기시합장에서 벌어진 것과 관련한 어떠한 개입과 간섭에 대해 묵과하지 않을 것임)

 

(2) "AIBA reiterates its unswerving commitment to the development of boxing using the most transparent and sustainable means possible, for the benefit of the entire boxing community." (AIBA는 전체 복싱공동체의 이익을 위하여 가장 투명하고 지속 가능한 수단들을 총 동원하여 복싱발전에 기여하고자 하는 확고부동한 약속을 재 천명하는 바임)
